Agreement to these terms

By accessing or using the Kraftmi website or Visperra, our AI jewelry advisor, you agree to these Terms of Service. If you do not agree with these terms, please do not use the service.

Kraftmi may update these terms from time to time as the service develops. Your continued use of Visperra after updated terms become effective means you accept the updated terms.

These terms are governed by the laws of England and Wales, subject to any mandatory rights or protections that apply to you under laws that cannot legally be excluded.

What the service is

Visperra is an AI-powered jewelry advisor operated by Kraftmi. You can show Visperra a photo of jewelry, a photo of yourself, an outfit, or ask a question in your own words — you can also combine these inputs. Visperra analyzes what you provide and gives you a styling or informational opinion — for example, which piece may suit you, how jewelry may work with an outfit, how pieces may pair together, or what you may want to consider before buying.

Visperra gives opinions and information, not guarantees. It is not a jewelry appraisal, valuation, authentication, grading, or certification service. It is not a substitute for professional advice, including advice from a qualified jeweler, gemologist, appraiser, insurer, financial adviser, or other professional. You should not rely on Visperra's output as professional certification of a piece's authenticity, value, condition, materials, purity, provenance, or suitability for insurance or resale.

Accuracy — what the AI can and can't tell

We'd rather be clear about the limits of AI than overstate what an image can show. Visperra can make useful observations from photographs and information you provide, but an image cannot reliably reveal everything about a piece of jewelry. For example:

  • White gold, platinum, and sterling silver can look very similar in photographs. Their exact composition generally cannot be reliably determined from appearance alone.
  • Gold-plated, gold-filled, and solid-gold jewelry may also look similar in photographs and cannot reliably be distinguished by visual inspection alone.
  • Exact gold purity, weight, gemstone authenticity, treatment, condition, provenance, or market value may require physical examination, testing, documentation, or professional assessment.
  • Lighting, camera quality, image angle, image editing, and missing information can affect what Visperra is able to determine.
  • Visperra can misunderstand an image, miss relevant details, or provide an incorrect recommendation.

Every recommendation is generated based on the information available to Visperra at the time. It can be wrong. If something cannot be reliably determined from the information provided, Visperra may say so rather than present an uncertain conclusion as fact.

Who can use Visperra

You must be at least 16 years old to use Visperra. By using the service, you confirm that you meet this requirement. If you are using Visperra on behalf of another person or organization, you confirm that you have the authority to do so.

Accounts and access

Visperra may be available without an account, depending on how the service is configured. Kraftmi may introduce accounts, usage limits, subscriptions, paid features, or other access requirements as the service develops.

If you create an account, you are responsible for providing accurate information and keeping your login credentials secure. You are responsible for activity carried out through your account unless that activity resulted from circumstances outside your reasonable control.

Kraftmi may limit, suspend, or terminate access to Visperra where reasonably necessary to protect the service, prevent abuse, enforce these terms, or comply with applicable law.

What you provide

You keep ownership of the photos, text, and other content you provide to Visperra. By submitting content, you give Kraftmi the permission it needs to receive, store, process, transmit, and analyze that content for the purpose of providing and operating Visperra. This permission does not transfer ownership of your content to Kraftmi.

How your personal information is handled is explained in our Privacy Policy. You are responsible for making sure that you have the necessary rights and permissions to provide any content you upload or submit. Please do not upload or submit:

  • content you do not have the right to share;
  • unlawful content;
  • content that infringes someone else's intellectual property or privacy rights; or
  • photographs of another person where you do not have an appropriate reason or permission to provide the image.

Acceptable use

You agree not to:

  • attempt to circumvent rate limits, usage restrictions, bot protection, authentication requirements, or other safeguards;
  • scrape, copy, harvest, or systematically extract content, data, or results from Visperra;
  • use Visperra to harass, threaten, impersonate, deceive, or harm another person;
  • upload malicious code, files, or other material intended to disrupt or compromise the service;
  • attempt to gain unauthorized access to Kraftmi's systems, accounts, infrastructure, or data;
  • reverse-engineer, decompile, disassemble, or otherwise attempt to discover the underlying source code, models, systems, or non-public components of Visperra, except where applicable law expressly permits this;
  • use Visperra to develop or train a competing service by systematically collecting or reproducing its outputs or functionality; or
  • use Visperra in a way that violates applicable law or these terms.

Intellectual property

Kraftmi owns or has the necessary rights to use the Kraftmi name, Visperra name, website, software, user interface, design, branding, text, graphics, and other materials provided as part of the service, except for content supplied by users or third parties. Nothing in these terms gives you ownership of Kraftmi's or Visperra's intellectual property.

You may use Visperra for its intended purpose, including obtaining jewelry styling and informational guidance for your personal use. You may not copy, reproduce, modify, distribute, sell, or commercially exploit Kraftmi's website, branding, software, design, or other proprietary materials without our permission.

Third-party services

Visperra relies on third-party technology and service providers to operate. These may include infrastructure, hosting, analytics, security, database, and AI service providers. Their availability and performance may affect Visperra, and Kraftmi cannot guarantee the continued availability or performance of any third-party service.

Availability and changes to the service

We may change, improve, suspend, or discontinue parts of Visperra from time to time. Features, usage limits, supported inputs, response formats, and availability may change as the service develops. We do not guarantee that any particular feature will always be available or that the service will always operate without interruption.

No warranty

To the fullest extent permitted by law, Visperra and its content are provided “as is” and “as available.” We work to make Visperra useful, reliable, and accurate, but we do not guarantee that:

  • the service will always be available or uninterrupted;
  • the service will be error-free;
  • every response will be accurate, complete, or current;
  • every recommendation will be suitable for you;
  • information provided by Visperra will meet your particular expectations; or
  • the service will identify every relevant characteristic of a jewelry piece, person, or outfit.

You are responsible for deciding whether and how to act on information or recommendations provided by Visperra.

Limitation of liability

To the fullest extent permitted by applicable law, Kraftmi will not be responsible for indirect, incidental, special, consequential, or unforeseeable loss or damage arising from your use of, or inability to use, Visperra. This includes, to the extent permitted by law, losses arising from decisions you make based on information or recommendations provided by Visperra, including decisions relating to purchasing, selling, wearing, valuing, insuring, or otherwise relying on jewelry.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited under applicable law. Nothing in these terms affects your statutory rights where those rights cannot legally be excluded.

Indemnity

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or reasonable costs incurred by Kraftmi as a result of your unlawful use of Visperra, your violation of these terms, or your infringement of another person's rights. This does not apply to the extent that the relevant loss was caused by Kraftmi's own negligence, unlawful conduct, or other circumstances for which liability cannot legally be transferred to you.

Suspension or termination

Kraftmi may suspend or terminate your access to Visperra if we reasonably believe that:

  • you have materially breached these terms;
  • you are using the service unlawfully or abusively;
  • you are attempting to compromise the security or operation of the service; or
  • suspension or termination is necessary to comply with applicable law.

You may stop using Visperra at any time. Where you have an account, additional account-specific terms may apply to closing or deleting that account.

Changes to these terms

Kraftmi may update these terms as Visperra develops. If we make a meaningful change to these terms, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of Visperra after updated terms take effect means that you accept the updated terms. If you do not agree with an updated version, you should stop using the service.

Governing law and jurisdiction

These terms are governed by the laws of England and Wales. Subject to any mandatory rights you may have under applicable law, the courts of England and Wales will have jurisdiction over disputes arising from these terms or your use of Visperra.
